On September 9, 2015 Encore Capital Group, Inc., and its wholly-owned subsidiaries Midland Credit Management, Inc., Midland Funding, LLC, and Asset Acceptance Capital Corp. (collectively “Encore” or “Midland”) entered into a voluntary Consent Order (the “Encore Consent Order”) with the Consumer Financial Protection Bureau (“CFPB”) covering debt-collection practices of the listed Encore subsidiaries. By this Stipulation, Encore has consented to the issuance of the Encore Consent Order by the Bureau, without admitting or denying any of the findings of fact or conclusions of law, except that Respondents admit the facts necessary to establish the Bureau's jurisdiction over Respondents and the subject matter of this action.
If you received by mail a letter or check from the Midland CFPB Settlement Administrator, your account was identified as one that was affected and eligible for redress. Accounts were eligible for redress based on two criteria: (i) Encore’s use of the word “settlement” in certain collection letters, or (ii) Encore’s reference, in certain affidavits to a consumer’s failure to dispute a debt during the FDCPA’s validation period, without including additional information relating to related FDCPA provisions.
